1. Purpose
This Acceptable Use Policy ("AUP") sets out the baseline rules of conduct that apply to all use of the Fire Call platform and services (the "Service"), regardless of whether you are a property owner, contractor, insurance agency staff member, or other user. It applies in addition to the other agreements that govern your use of the Service, including the Terms of Service, the Agency Master Services Agreement, and the Contractor Service Agreement.
If a role-specific agreement imposes stricter or different obligations on you for a particular topic, that role-specific agreement controls for that topic. Otherwise, this AUP applies.
2. Prohibited Content
You will not upload, submit, or otherwise transmit through the Service any content that:
- Is unlawful, defamatory, libelous, fraudulent, deceptive, or misleading
- Infringes or misappropriates any patent, copyright, trademark, trade secret, publicity, privacy, or other intellectual property or proprietary right of any party
- Contains personal information about another person that you do not have the right to submit, including health information, financial information, or government identifiers
- Contains explicit sexual content, child sexual abuse material, or content that sexualizes minors
- Promotes or incites violence, terrorism, self-harm, or harm to others
- Constitutes harassment, bullying, threats, hate speech, or discrimination based on race, ethnicity, national origin, religion, sex, gender, sexual orientation, disability, age, or other protected characteristics
- Contains viruses, malware, ransomware, worms, time bombs, Trojan horses, or any other code designed to disrupt, damage, or limit the functioning of any system
- Misrepresents the identity, qualifications, licensing, or affiliation of any person or organization
- Misrepresents the nature, condition, or ownership of any property in a way that materially affects an inspection, quote, or remediation work
- Contains photos or recordings of any person taken without their knowledge or consent in circumstances where consent would reasonably be expected
3. Prohibited Activities
You will not, and will not attempt to:
- Use the Service for any unlawful purpose or in violation of any local, state, national, or international law or regulation
- Submit fraudulent inspections, hazard reports, quotes, bids, or claims, or solicit or encourage another person to do so
- Submit information for a property you do not own and are not authorized to submit information about
- Use the Service to file or facilitate a fraudulent insurance claim or to mislead an insurance agency or carrier
- Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with any person or entity
- Use the Service to send unsolicited bulk communications, spam, or chain messages
- Probe, scan, or test the vulnerability of the Service or any associated system or network, or breach or attempt to breach any security, authentication, or access control measure, except under a written security testing agreement with Fire Call
- Decompile, reverse engineer, disassemble, or otherwise attempt to derive the source code of any portion of the Service, except as expressly permitted by applicable law
- Scrape, crawl, harvest, index, mine, or otherwise extract information from the Service through automated means or other unauthorized methods, except through interfaces and rate limits that we expressly provide for that purpose
- Interfere with or disrupt the integrity or performance of the Service, or impose an unreasonable or disproportionately large load on Fire Call's infrastructure
- Access the Service through any means other than the interfaces and methods we provide, including through unauthorized APIs, screen scrapers, or automated tools
- Frame, mirror, or otherwise incorporate any part of the Service into another website or service without our prior written consent
- Remove, obscure, or alter any proprietary notices, including copyright, trademark, or attribution notices, on or in the Service
- Resell, sublicense, rent, lease, or otherwise commercialize access to the Service to a third party, except as expressly permitted by the agreement governing your role on the Service
- Use the Service to compete with Fire Call, to develop a competing product or service, or to benchmark performance for the benefit of a competitor
- Circumvent any technical limitation, access control, usage limit, geographic restriction, or other restriction imposed by Fire Call
- Use the Service to engage in any activity that could expose Fire Call, its users, or third parties to legal liability or reputational harm
4. Account Conduct
You will:
- Provide accurate, current, and complete information when registering and keep that information up to date
- Use only one account per individual or entity, unless we expressly authorize otherwise
- Keep your credentials confidential and not share them with any other person
- Be responsible for all activity that occurs under your account
- Promptly notify Fire Call of any unauthorized use of your account or any other security incident affecting your account
- Not create an account using false identity information or for the purpose of evading a prior suspension or termination
5. Communications Conduct
In communications conducted through or facilitated by the Service, you will:
- Treat other users, Fire Call personnel, and any third parties with courtesy and respect
- Communicate accurately and in good faith
- Not threaten, intimidate, harass, or harm any person
- Not use the Service's communication features to send commercial solicitations to other users without prior consent
- Not use the Service to solicit payments, gratuities, or other consideration outside the channels Fire Call provides
6. Reporting Violations
If you become aware of a violation of this AUP, including content or conduct that harms or threatens to harm a person, property, or the Service, report it to legal@firecall.us. We will review reports in good faith and take action where appropriate. We may, but are not required to, follow up with the reporter or share the outcome of an investigation.
7. Enforcement
Fire Call reserves the right, but is not obligated, to monitor use of the Service for compliance with this AUP. We may investigate suspected violations using any means available to us, including reviewing account activity, content submitted to the Service, and information provided by other users or third parties.
In response to a suspected or confirmed violation, Fire Call may, at its discretion:
- Issue a warning
- Remove or disable access to violating content
- Restrict access to certain features or functions
- Suspend the account or specific user's access to the Service
- Terminate the account, with or without notice depending on the severity of the violation
- Withhold payments to the extent permitted under the role-specific agreement governing the user
- Cooperate with law enforcement, regulators, or other authorities, including by providing information about the user and their activity, where required by law or where Fire Call believes such cooperation is appropriate to address the violation
- Pursue legal remedies, including damages and injunctive relief
Fire Call's enforcement actions are not exclusive remedies, and our failure to enforce any provision of this AUP in a particular case is not a waiver of our right to enforce that provision later or in other cases.
8. Changes to This Policy
Fire Call may update this AUP from time to time. When we do, we will publish the updated version at a new version-specific URL (for example, /aup/v2-YYYY-MM-DD) and note the new effective date. The version of this AUP in effect when you accepted it remains accessible at its version-specific URL. For non-material changes, the updated version takes effect immediately and applies to your continued use of the Service. For material changes, we will provide reasonable advance notice by email or in-product notice, typically at least thirty (30) days. Your continued use of the Service after the effective date constitutes acceptance.
