1. Introduction
Welcome to Fire Call. These Terms of Service ("Terms") govern your use of the Fire Call website, mobile experiences, and services (collectively, the "Service"), operated by Fire Call, LLC, an Idaho limited liability company ("Fire Call," "we," "us," or "our").
These Terms apply to property owners and other individual users of the Service. If you are using the Service on behalf of an insurance agency, your access is governed primarily by the Agency Master Services Agreement. If you are participating on the platform as a service provider, your access is governed primarily by the Contractor Service Agreement. These Terms still apply to you to the extent they are not in conflict with those other agreements.
By creating an account, requesting a quote, submitting information through the Service, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 18 years old to use the Service. By using the Service, you represent that you are at least 18 and have the legal capacity to enter into these Terms.
2. What Fire Call Does
Fire Call helps property owners assess and reduce wildfire risk. The Service typically allows you to:
- Participate in a wildfire risk inspection arranged by your insurance agency or initiated by you
- Submit photos and information about your property for hazard assessment
- Request a quote for remediation work to address identified hazards
- Engage Fire Call to perform remediation work, which Fire Call fulfills through vetted independent contractors
- Track the status of inspections and remediation work
Fire Call may update the Service from time to time, adding, modifying, or removing features. We may also offer different features to different users.
3. Accounts
Some features of the Service require an account. You agree to provide accurate, current, and complete information when creating an account, and to keep that information up to date. You are responsible for safeguarding your account credentials and for any activity that occurs under your account.
You agree to notify Fire Call promptly if you suspect unauthorized access to your account or any other security issue. We may suspend or terminate your account if we suspect it has been compromised or used in violation of these Terms.
You may close your account at any time, either by using the account-deletion option in your dashboard settings or by contacting legal@firecall.us. Account deletion is processed promptly and removes your account data from our systems, except for records we are required by law to retain, records subject to an ongoing or threatened legal matter, and de-identified or aggregated data that no longer identifies you. Our full deletion-and-retention practices are described in the Privacy Policy.
4. Inspections and Quote Requests
If you participate in an inspection — whether initiated by an insurance agency or by you — by submitting photos, addresses, or other information, you confirm that:
- You are the property owner, or you have the property owner's permission to submit the inspection
- The information you submit is accurate to the best of your knowledge
- You understand that inspection results may be shared with the insurance agency that issued the inspection link, and with contractors engaged to perform remediation
- You consent to the processing of your information as described in our Privacy Policy and any inspection-specific privacy notice you received
When you request a quote for remediation work, you understand that the quote is an estimate based on the information provided and may be revised if conditions on the property are different than described or photographed.
Fire Call does not guarantee any specific outcome, including any particular impact on your insurance rates, eligibility, or policy status. Those decisions are made by your insurance agency or carrier.
5. Remediation Work
If you engage Fire Call to perform remediation work, the specific scope, pricing, and terms of that work are set forth in a separate job agreement (typically signed through DocuSign). That job agreement, together with these Terms, governs the work.
You contract directly with Fire Call for the work. Fire Call fulfills the work through vetted independent contractors. The contractors are not your direct counterparty; if you have an issue with the work, your remedy is against Fire Call.
The price you pay Fire Call for remediation work includes Fire Call's margin for operating the platform, vetting contractors, administering payment, and providing customer support. Fire Call sets the price; the underlying compensation paid to the contractor is separate and not itemized.
6. Payment
Payment for remediation work is processed by our payment processor, Stripe. You authorize Fire Call to charge your designated payment method for amounts owed under any job agreement you sign.
Unless the job agreement states otherwise, payment terms (including deposits, milestone payments, and final payment) are described in that document. Late payments may incur fees as set forth in the job agreement or as permitted by law.
If you dispute a charge, contact us at legal@firecall.us before initiating a chargeback, so we can work to resolve the issue directly.
7. Your Content
You may upload photos, descriptions, and other content to the Service ("Your Content"). You retain ownership of Your Content.
By submitting Your Content, you grant Fire Call a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, display, modify, distribute, and use Your Content for the purposes of:
- Operating, providing, and improving the Service
- Sharing inspection and remediation information with the insurance agency that issued an inspection link, where applicable
- Sharing relevant information with contractors engaged to perform remediation
- Internal quality assurance, training, and dispute resolution
- Aggregated and de-identified analytics
- Demonstrating the Service to other potential customers, in a manner that does not identify you by name or address without your consent
You represent and warrant that you have all rights necessary to grant the licenses above, and that Your Content does not violate any third party's rights or any law.
We are not obligated to store Your Content indefinitely. Retention periods are described in our Privacy Policy.
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any law
- Submit information you do not have the right to submit, or that is false, misleading, or fraudulent
- Impersonate any person or misrepresent your affiliation with any person or entity
- Upload viruses, malware, or other harmful code
- Attempt to gain unauthorized access to the Service, other users' accounts, or our systems
- Probe, scan, or test the vulnerability of the Service, or breach any security or authentication measure
- Reverse engineer, decompile, or attempt to derive the source code of the Service, except as expressly permitted by law
- Scrape, crawl, or harvest information from the Service except through interfaces we provide for that purpose
- Use the Service to harass, threaten, or harm any person
- Interfere with or disrupt the Service or use it in a way that imposes an unreasonable load on our infrastructure
- Use the Service to compete with Fire Call or to build a competing product
We may investigate and respond to suspected violations, including by suspending or terminating accounts and reporting conduct to law enforcement where appropriate.
These Terms incorporate by reference the Acceptable Use Policy at /aup, which sets out additional platform-wide rules of conduct.
9. Communications
By creating an account or otherwise providing your contact information, you consent to receive communications from Fire Call related to the Service. This includes transactional messages (account notifications, inspection updates, job status, payment receipts) and operational messages (security alerts, important changes to the Service).
We may contact you by email, in-product notification, or phone, depending on what contact information you have provided and what permissions you have granted.
We will only send you marketing or promotional communications with your separate opt-in, and you can unsubscribe at any time using the link in those messages or by contacting us.
10. SMS / Text Messaging
Opt-in and scope. By providing your mobile phone number and selecting text-message delivery during identity verification, you consent to receive one-time verification codes via SMS from Fire Call to confirm your identity during agency inspections. Fire Call does not use SMS for marketing, promotions, or service-request status updates.
Message frequency. Message frequency varies based on your activity. Verification codes are sent only when you request them.
Carrier charges. Message and data rates may apply. Check with your wireless carrier for details.
Opting out and help. Reply STOP to any Fire Call SMS to opt out at any time. Reply HELP for assistance, or contact us at info@firecall.us.
Supported carriers. Supported carriers include AT&T, T-Mobile, Verizon, and other major U.S. carriers. Carriers are not liable for delayed or undelivered messages.
Geographic scope. SMS service is available in the United States only.
Consent not required. Consent to receive SMS is not required to use the Service. You may verify your identity by email at any time.
11. Third-Party Services
The Service uses third-party providers to support its operations, including Stripe (payment processing), DocuSign (contract signing), Firebase (authentication), Twilio (SMS), and others identified in our Privacy Policy. Your use of these services through Fire Call is subject to their own terms, in addition to these Terms. We are not responsible for the acts or omissions of third-party providers beyond our reasonable control.
12. Intellectual Property
The Service, including its software, design, text, graphics, logos, trademarks, and all other content provided by Fire Call (collectively, the "Fire Call Materials"), is owned by Fire Call or its licensors and is protected by intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, subject to these Terms. No other rights are granted to you. You may not copy, modify, distribute, sell, or create derivative works of the Fire Call Materials except as expressly permitted.
If you submit feedback, suggestions, or ideas about the Service, you grant Fire Call a perpetual, irrevocable, royalty-free license to use that feedback for any purpose without obligation to you.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, FIRE CALL DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Fire Call does not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. Fire Call does not warrant the accuracy of inspection results, automated hazard detection, AI-generated content, or any quote estimates. Wildfire risk assessment is inherently uncertain, and no inspection or remediation can eliminate the risk of wildfire damage to your property.
Fire Call does not warrant any specific outcome of remediation work, including any particular impact on your insurance rates, eligibility, or policy status. Decisions about insurance coverage are made by your insurance agency or carrier, not by Fire Call.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FIRE CALL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA, ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
FIRE CALL'S TOTAL AGGREGATE LIABILITY TO YOU ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO FIRE CALL IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
The limitations in this Section 14 do not apply to liability that cannot be limited under applicable law. The parties acknowledge that these limitations are a fundamental basis of the bargain. Liability arising out of a specific job agreement is addressed by that job agreement.
15. Indemnification
You agree to indemnify, defend, and hold harmless Fire Call and its officers, directors, employees, and agents from and against any claim, loss, damage, liability, cost, or expense (including reasonable attorneys' fees) arising out of or relating to (a) your breach of these Terms, (b) Your Content, (c) your violation of any law or any third party's rights, or (d) your misuse of the Service. Fire Call will promptly notify you of any such claim, allow you to control the defense (provided no settlement requires Fire Call to admit liability or pay money without its consent), and reasonably cooperate at your expense.
16. Termination
You may stop using the Service or close your account at any time. We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms or for risks to the Service or its users. Where reasonably practicable, we will give you notice of suspension or termination.
Sections that by their nature should survive termination — including Sections 7, 12, 13, 14, 15, 17, and 21 — will survive. Termination does not affect your obligations under any job agreement already in progress, or our right to retain information as described in the Privacy Policy.
17. Dispute Resolution and Arbitration
Please read this Section carefully. It affects your legal rights, including by requiring most disputes to be resolved through binding individual arbitration rather than in court, and by waiving the right to participate in class actions.
Informal resolution. Before filing any formal claim, you agree to first contact Fire Call at legal@firecall.us to attempt to resolve the dispute informally. The parties will negotiate in good faith for at least thirty (30) days.
Binding arbitration. If informal resolution does not succeed, any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, except as otherwise stated below. The arbitration will be conducted by one arbitrator, in English, with the seat in Ada County, Idaho, or another location mutually agreed by the parties (which may include conducting the arbitration remotely). The arbitrator's decision is final and may be entered as a judgment in any court of competent jurisdiction.
Class action waiver. Each party may bring claims against the other only in its individual capacity, and not as a plaintiff or class member in any purported class, collective, representative, or consolidated action. The arbitrator may not consolidate claims of multiple parties or preside over any class or representative proceeding.
Exceptions. Notwithstanding the foregoing, either party may (a) bring an individual action in small claims court for claims within that court's jurisdiction, or (b) seek injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual property, confidential information, or to enforce payment obligations, without first resorting to arbitration. The federal and state courts located in Ada County, Idaho will have exclusive jurisdiction over any such court actions, and the parties consent to personal jurisdiction and venue there.
18. Governing Law
These Terms are governed by the laws of the State of Idaho, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
19. Changes to These Terms
We may update these Terms from time to time. When we do, we will publish the updated version at a new version-specific URL (for example, /terms/v3-YYYY-MM-DD) and note the new effective date. The version of these Terms in effect when you accepted them remains accessible at its version-specific URL.
For non-material changes (clarifications, formatting, corrections), the updated version takes effect immediately and applies to your continued use of the Service. For material changes — including changes that expand your obligations, restrict your rights, or change the allocation of risk — we will provide reasonable advance notice, typically at least thirty (30) days, by email or in-product notice. Your continued use of the Service after the effective date constitutes acceptance. If you do not agree to a material change, you may stop using the Service before the effective date.
20. Communications and Notices
Notices to Fire Call must be sent to legal@firecall.us. Notices to you may be sent to the email address associated with your account or delivered through the Service. You agree to keep your contact information current. Fire Call is not responsible for notices that fail to reach you because your contact information is out of date.
You consent to receive electronic communications and agree that electronic communications satisfy any legal requirement that a communication be in writing.
21. Miscellaneous
Independent parties. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Fire Call.
Assignment. You may not assign these Terms or any rights under them without our prior written consent. We may assign these Terms freely.
Force majeure. Neither party is liable for delay or failure to perform (other than payment obligations) due to events beyond its reasonable control, including natural disasters, wildfires, acts of war or terrorism, civil unrest, pandemics, internet or telecommunications failures, or actions of governmental authorities.
Severability. If any provision of these Terms is held unenforceable, the remaining provisions remain in full force, and the unenforceable provision will be modified to the minimum extent needed to make it enforceable while preserving the parties' intent.
No waiver. Our failure to enforce a provision is not a waiver of our right to enforce that provision later.
Entire agreement. These Terms, together with the Privacy Policy and any job agreements or other written agreements between you and Fire Call, constitute the entire agreement between you and Fire Call about its subject matter and supersede all prior agreements, communications, and understandings.
Electronic acceptance. These Terms may be accepted electronically. Electronic acceptance has the same legal effect as a signed paper original.
